外国人漁業の規制に関する法律

外規法（外国人漁業の規制に関する法律）により、

滋賀県の琵琶湖では外国人によるビワマストローリングは禁止されています。

遊漁船に乗ってのビワマスジギングは許可されています。

According to the Foreign Fisheries Restriction Act,

Biwa trout trolling by foreigners is prohibited in Lake Biwa in Shiga Prefecture.

Biwa trout jigging is permitted.

外国人漁業の規制に関する法律

外国人による遊漁（トローリング（ひき縄づり））について

１ 現行制度の概要

（１）水産動植物の採捕（遊漁によるものを含む。）の制度概要

日本人による水産動植物の採捕（遊漁によるものを含む。）については、漁業法

等により漁具漁法の制限が行われているが、こうした制限を受けることなく採捕可

能なものを、都道府県が漁業調整規則で定めている。具体的に漁業調整規則で遊漁

者等が行える漁具漁法は、さおづり、手づり、たも網等となっている。ただし、漁

業調整委員会指示により、遊漁に関する制限を設けている場合もある。

一方、外国人に対する軽易な水産動植物の採捕（遊漁によるものを含む。）につ

いては、

① 領海及び内水では、上述の国内制度（漁業関連法令）及び外国人漁業の規制に

関する法律（以下「外規法」という。）

② 排他的経済水域では、排他的経済水域における漁業等に関する主権的権利の行

使等に関する法律（以下「漁業主権法」という。）

により漁具漁法等を定めている。具体的な内容は、外規法施行規則及び漁業主権法

施行規則において、さおづり、手づり、たも網等となっている。

（２）トローリング（ひき縄づり）について（遊漁によるもの）

遊漁における「トローリング（ひき縄づり）」については、水産資源の保護培養

又は漁業調整上の観点から、多くの都道府県の漁業調整規則で禁止されているが、

複数の都道府県では、遊漁者等が行えることになっている。ただし、これらの都道

府県の多くは、漁業調整委員会指示により採捕者等の承認制を導入し、漁業と遊漁

の調整を図っている。

しかしながら、外国人については、外規法施行規則及び漁業主権法施行規則によ

り、こうした都道府県であっても遊漁等でこの漁法を行うことはできない。

Regarding recreational fishing by foreigners (trolling)

1. Overview of the current system

(1) Overview of the system for the capture of aquatic animals and plants (including recreational fishing)

The Fisheries Law and other laws restrict the fishing gear and fishing methods used by Japanese people to capture aquatic animals and plants (including recreational fishing), but prefectures set out fisheries adjustment regulations that allow them to be captured without these restrictions. Specifically, the fishing gear and fishing methods that recreational fishers can use under the Fisheries Adjustment Regulations include pole fishing, hand fishing, and dip net fishing. However, there are cases where restrictions on recreational fishing are imposed by instructions from the Fisheries Adjustment Committee.

On the other hand, regarding the light capture of aquatic animals and plants by foreigners (including recreational fishing),

① In territorial waters and inland waters, the above-mentioned domestic system (fishery-related laws and regulations) and the Law on the Regulation of Foreign Fisheries (hereinafter referred to as the "Foreign Fisheries Law")

② In the exclusive economic zone, the fishing gear and fishing methods are stipulated by the Law on the Exercise of Sovereign Rights Regarding Fisheries, etc. in the Exclusive Economic Zone (hereinafter referred to as the "Fisheries Sovereignty Law").

Specific details are pole fishing, hand fishing, and seine fishing in the Enforcement Regulations of the Foreign Fisheries Law and the Fisheries Sovereignty Law.

(2) Trolling (Recreational Fishing)

Recreational "trolling" is prohibited by the Fisheries Adjustment Regulations of many prefectures from the perspective of protecting and cultivating fishery resources or adjusting the fisheries, but in several prefectures, recreational fishers, etc. are allowed to do it. However, many of these prefectures have introduced a system of approval for catchers under the direction of the Fisheries Adjustment Committee, and are trying to balance recreational fishing with commercial fishing. However, as for foreigners, according to the Enforcement Regulations of the Foreign Trade Control Law and the Fisheries Sovereignty Law, even in these prefectures, they cannot use this fishing method for recreational fishing.
